Open Burn Permit – Town of Oakland Fire Department
Outdoor burning within Town limits is regulated under the International Fire Code (Section 307) and enforced by the Fire Code Official or designee.
Approved Burning Types
- On-site vegetation disposal (leaves, twigs, yard debris, tree debris)
- Minimum 50 ft clearance
- Bonfires (over 3 ft diameter × 2 ft height)
- Minimum 50 ft clearance
- Cooking fires / barbecue
- Minimum 25 ft clearance
- Recreational fires (campfires under 3 ft diameter × 2 ft height)
- Minimum 25 ft clearance
- Other non-recreational fires (must specify materials)
Permit Requirements
- Permit is valid only for approved dates and times
- Fire must be constantly attended until fully extinguished
- Fire must be completely extinguished by the approved time
- Must have extinguishment tools immediately available (e.g., water hose, extinguisher, shovel)
- Permit holder must notify the Fire Department before ignition and after extinguishment
Safety Rules
- Fire must be a safe distance from structures (as specified on permit)
- Burning must be conducted in a safe and controlled manner
- The Fire Department may revoke permits at any time due to:
- Excessive smoke
- Unsafe conditions
Prohibited Materials
Burning the following is strictly forbidden:
- Trash or household garbage
- Plastics or rubber (including tires)
- Aerosol or chemical containers
- Asphalt roofing, shingles, siding
- Asbestos-containing materials
- Insulated wiring
Treated, painted, or manufactured wood (plywood, particle board, etc.)
-Tennessee State Law only allows the burning of natural vegetation
Burning prohibited materials will result in:
- Immediate extinguishment
- Revocation of permit
Weather Restrictions
- Permits may be denied or revoked due to:
- High winds
- Dry conditions
- Regional burn bans
Responsibility
- Permit holder is legally responsible for the fire and any damages
- A permit does not remove liability
Emergency
- If fire becomes uncontrolled: Call 911 immediately
